Kagan on Second Amendment: Like Freedom of Speech Enjoys “Strong But Not Unlimited Protection”

During her confirmation as solicitor general, Kagan said the Second Amendment, like freedom of speech, enjoys “strong but not unlimited protection.”

In a questioner from Sen. Chuck Grassley (R) about gun rights during her confirmation to be Solicitor General, Kagan had this to say:

“Once again, there is no question, after Heller, that the Second Amendment guarantees individuals the right to keep and bear arms and that this right, like others in the Constitution, provides strong although not unlimited protection against governmental regulation.” – Source: Kagan Watch

Anti-war 9/11 families oppose Holder proposal to modify Miranda

(RawStory) – During an interview Sunday on ABC television’s current affairs talk show This Week, Attorney General Eric Holder suggested creating an exception to so-called Miranda rights established in a 1966 Supreme Court ruling that forbids prosecutors from using statements made by suspects before they have been warned that they have a right to remain silent.

“We’re now dealing with international terrorists,” the attorney general told NBC television. “And I think that we have to think about perhaps modifying the rules that interrogators have and somehow coming up with something that is flexible and is more consistent with the threat that we now face.”

Steele, the Secessionist Party Candidate for Governor of Vermont was merely, though persistently, asking a question of the other candidates regarding the use of ’state secession’ as a way of dealing with Vermont’s $50 million share of the National deficit — he was promptly arrested. This arrest however was unwise, primarily because it is not the way things are done in our free constitutional republic. Lieberman Looks to Strip the Citizenship of 1 Million Americans Without Charge or Trial

Hijacking the Constitution and the Bill of Rights

(FutureofFreedomFoundation) – In an editorial yesterday entitled “Obama Administration Owes Answers on How It Handled Times Square Suspect,” the Washington Post wants to know whether the Obama administration was too hasty in treating accused Times Square terrorist Faisal Shahzad as a criminal suspect rather than an “enemy combatant.”

The Post stated:

“The administration rightly came under fire for its handling of the case of Umar Farouk Abdulmutallab, a Nigerian citizen who tried to ignite explosives on a Detroit-bound plane on Christmas Day. In that case, the Justice Department … rashly embraced a law enforcement approach without fully considering other options, including holding Mr. Abdullmutallab as an enemy combatant.” (Emphasis added.)

The Post goes on to say:

“The Shahzad case is different, primarily because Mr. Shahzad is an American citizen.”

Mexico’s illegals laws tougher than Arizona’s

(WashingtonTimes) – Mexican President Felipe Calderon denounced as “racial discrimination” an Arizona law giving state and local police the authority to arrest suspected illegal immigrants and vowed to use all means at his disposal to defend Mexican nationals against a law he called a “violation of human rights.”

But the legislation, signed April 23 by Arizona Gov. Jan Brewer, is similar to Reglamento de la Ley General de Poblacion — the General Law on Population enacted in Mexico in April 2000, which mandates that federal, local and municipal police cooperate with federal immigration authorities in that country in the arrests of illegal immigrants.

Under the Mexican law, illegal immigration is a felony, punishable by up to two years in prison. Immigrants who are deported and attempt to re-enter can be imprisoned for 10 years. Visa violators can be sentenced to six-year terms. Mexicans who help illegal immigrants are considered criminals.

The law also says Mexico can deport foreigners who are deemed detrimental to “economic or national interests,” violate Mexican law, are not “physically or mentally healthy” or lack the “necessary funds for their sustenance” and for their dependents. Full article here
