Texas Representatives Introduce Resolution Asserting Sovereignty Under Tenth Amendment

Texas has joined the states’ right and Tenth Amendment movement by introducing House Concurrent Resolution No. 50, filed earlier this week by Republican state representatives Leo Berman, Brandon Creighton, and Bryan Hughes. H.C.R. 50 cites Section 4, Article IV, of the Constitution, the Tenth Amendment, and the Ninth Amendment.

“The Tenth Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp,” the resolution declares, while “Section 4, Article IV, of the Constitution says, ‘The United States shall guarantee to every State in this Union a Republican Form of Government,’ and the Ninth Amendment states that ‘The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.’”

A number of proposals from previous administrations and some now pending from the present administration and from congress may further violate the Constitution of the United States; now, therefore, be it RESOLVED, That the 81st Legislature of the State of Texas hereby claim sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States…

H.C.R. 50 serves “as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers” and that “all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or that requires states to pass legislation or lose federal funding be prohibited or repealed.”

Finally, the resolution directs the Texas secretary of state to forward official copies of the resolution to president Obama, Speaker of the House Pelosi, the president of the Senate, Joe Biden, and all members of the Texas delegation to the Congress. In addition, there is an official request that the resolution be entered in the Congressional Record as a “memorial to the Congress of the United States of America.”

Texas joins Washington, New Hampshire, Arizona, Montana, Michigan, Missouri, Oklahoma, California, and Georgia, states that have all introduced bills and resolutions declaring sovereignty under the Tenth Amendment. Colorado, Hawaii, Pennsylvania, Arkansas, Idaho, Indiana, Alaska, Kansas, Alabama, Nevada, Maine, and Illinois are also considering such measures.

“While the ramifications of these resolutions are still uncertain, one thing is clear,” writes Barbara Minton. “People are sick and tired of the federal government’s usurpation of power not granted to it by the Constitution. They have had enough of fear based economic terrorism and underhanded promotion of policies and procedures that bypass public scrutiny and the will of the people.”

It should be noted that a resolution is a statement and not law and does not necessarily represent a consensus of a state legislature. “Still, the fact that two states, California and Georgia, have already passed their versions of state sovereignty may be setting the stage for secession down the road if the federal government continues to show its scorn for the Constitution. The Oklahoma resolution has already passed in the House and is awaiting vote in the state Senate to be codified,” writes Minton.

As should be expected, the corporate media has all but ignored H.C.R. 50, while Vince Leibowitz of Dallas-based Pegasus News calls the resolution “bizarre” and intimates that Berman, Creighton, and Hughes are insane. Leibowitz’s comments are a sad testament on how out of touch many Americans are when it comes to the Constitution and the increasing encroachments of the federal government.

  1. Probably no other state in the union has demonstrated such snakebit political leadership as the Lonestar State. I hope they secede from the union and the Mexicans overrun them. Texas oil men have ruined the country. It’s a high time a strong president throttled these radicals down and put them in their place.

    To Rattlesnake Bob: My great-grandfather fought with and was wounded in the 14th NY H Arty during the Civil War. He would find a kinship with present day Texas more than current day NY. Bring it on!

  5. Texas should secede. It would cause some rational thought in the corrupt federal government to see that OUR STATE will stand up for it’s people. We are one of the states that can stand alone. Enough oil/gas, refineries, ports, crops, and a willing workforce to see it through.

    I for one am sick and tired of watching the corporate giants and elected officials doing for the special interests and foreign countries in the name of PROFITS, rather than what’s good for OUR country.

  7. Before the Confederacy did this there were some other Americans who asserted their rights. They called them ‘inalienable rights” and wrote them in a document nobody uses anymore. They also limited what the federal government can and can’t do, but somehow that too has been lost. The feds are clearly off the reservation the founders put them on. Time to reign them in.

  9. It should be a concern to every taxpaying American that our federal government is no longer by or for the people within the Constitution. Those of us born and raised in Texas have seen our forefathers fight to preserve the freedoms we enjoy (exclude LBJ, not many have figured out what he was thinking except the liberals who enjoyed a bit of recognition during his time as President. Dan Rather, Bill Moyers and a few others behind the scenes). Nor George Bush(more East Cost establishment, Harvard, Princeton, Yale and Cheney puppeteer, than true Texas). Many think ill of the oil and gas business and only see the profits of the major oil companies not the hardworking independents that provide more jobs, better schools, pay more taxes and help the local economies of countless cities and counties in our State. Yes, Texas has undergone change as many have chosen to move here and call it home. We welcome those who genuinely believe in hardwork and earning a living, not something for nothing just because you are a minority. To those that work the system in their favor I suggest strongly you learn English, skill and get a job. We have a great number of hardworking, God loving Latinos(Mexicans) in our State and we always welcome them but again suggest they do all they can to be legally working here. Any group, organization or person that thrives on stirring up hatred, divisiveness or any other form of negative propaganda needs to reevaluate their priorities and do what’s best for all not just a few. Party Politics isn’t good for anyone except politicians therefore take time to study those you chose to support, know their voting record, observe and read between the lines as to their true motivation. We have some good people who start out in politics with great intentions only to be waylaid by their own party as to their political future. If and when they compromise their principles to gain political power, position or favor they are on the road to the will of the Party not the People!

I have been hoping for something like this since it became obvious that states like Texas were going to be penalized for actually SAVING money during the good times, rather than just shovel it into imprudent programs and union raises like CA and NY, who then beg for bailouts while they refuse to cut their budget.

    The Mexicans are much preferable to the Bolsheviks in Washington. Besides, nobody will overrun anybody. The Feds are a no-show on the southern border; the Texas National Guard will do just fine, in the unlikely possibility they be needed.

  11. Im all for Texas and every other state seceding from our new fascist federal govt. The only problem I have is if I remember correctly, Rick Perry is a Bilderberg member. I have no choice but to question his true motives. Can anyone help me out? No Bilderberg traitor could possibly have the interests of the people in heart or mind.

The states are sovereign of their very nature.Whether there is or isn’t a 10th Amendment the states are sovereign period.What I am saying is that there is no absolute necessity to declare sovereignty.The 10th Amendment is a Constitutional law.But the situation has become so desparate that is has become necessary to remind the federal government of the proper relationship it holds with the states by a series of resolutions and to put the federal government on notice.

    Amendment X

    The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people

    The powers of the federal government are few,enumerated[Art1 Sec8],and delegated by the states to the federal government.The powers of the states are many and unenumerated.Is not for the courts or Congress to spell out for the states what the retained powers and rights of the states are.It would be absurd for the states to have powers if they didn’t have the right to exercise them.

    As far as the spending clause is concerned,the states being able to promote their own welfare,do not have to accept money from the goverment such as the stimulus package.Congress has no business providing for the general welfare of a state unless the state is in need and the states can look for assistance elsewhere if they so choose.How stupid for the federal government to give money to a state that doesn’t need it or want it.

    As far as the necessary and proper clause is concerned this refers to Art1 Sec8 of the
    Constitution.Whatever “department” means in this clause, it refers to the Federal government and not to the states.But in reality it again refers to Art1 Sec8 of the Constitution and the departments enumerated under Art1 Sec8.We all know that there have been countless departments,agencies,
    and federal laws and regulations that have been forced on the states.The resolutions have put on notice these departments and agencies as to what will be considered legitimate or intrusive into matters that belong to the states alone.

    The states also have Art6 which is the Supremacy Clause to contend with.

    This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding

    However laws not made in pursuance of the Constitution are unconstitutional and this goes for the innumerable laws made by these agencies and applied to the states.The states,being sovereign, under the 10th Amendment can decide what will be allowed and what will not be tolerated.

    Of note is the fact that state legislatures have the authority to overturn federal laws even those emanating from the Supreme Court.[John Taylor of Caroline-New Views of the Constitution]

    The resolutions made under the 10th Amendment reinforce the reality that the states are sovereign of their very nature and will no longer tolerate the unwarranted intrusions of the federal government,their laws,agencies,and departments that have no authority within these sovereign states.

  13. I just want to make it clear that the states do not need to make resolutions to assert sovereignty since they are sovereign of their very nature. If the resolutions under the 10th Amendment do anything they should simply remind the federal government that the states are sovereign and being so are declaring to the federal government the state of affairs concerning this matter and will no longer have their rights trampled on in a manner that is unconstitutional
