“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under that Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.” – Article VI, Clause 2 of the U.S. Constitution
(TenthAmendmentCenter) – Recently I attended a gun show, where I handed out information material and answered questions on the Tenth Amendment Center. Several people were concerned about the U.S. making a treaty that would gut the U.S. Constitution and potentially take away firearms from law abiding citizens here in the U.S. They argued that the paragraph above from the Constitution places treaty law above the Constitution as the supreme law of the land.
Our Founders very clearly stated the conditions under which the U.S. Constitution could be amended, or changed, in Article 5. It is quite illogical to conceive that our Founders would write such a brilliant document to be the foundation of our union, only to create a giant backdoor for foreign governments to come in and destroy the liberty we had worked so hard to achieve. In fact, our Founders themselves said otherwise. Continue reading →
(FFF) – If you want to know what tyranny is like, look around.
The national government — specifically the executive branch — can do pretty much what it wants. It could bomb Iran tomorrow without a declaration of war from Congress. It can — and does — conduct secret wars and covert operations against countries that have done nothing to us. Of course, they are secret only to the ignorant taxpayers who must finance them and perhaps suffer when the provoked retaliation occurs. It can have men behind PlayStation consoles in Nevada fire Hellfire missiles from aerial drones on people in Pakistan, Yemen, and elsewhere.
This tyrannical government can send any foreigner picked up anywhere in the world to third countries known for torturing prisoners. It can hold people accused of nothing indefinitely in prisons in Cuba and Afghanistan and torture them into making false confessions. It can conduct a war crimes trial in a military kangaroo court for a man, Omar Khadr, held captive for eight years after he was picked up at the age of 15 during a U.S. assault on villagers near Kabul. His torture-induced “confessions” will be admissible. All this is in violation of commitments under the Optional Protocol on the Involvement of Children in Armed Conflict not to treat children in war as though they were adults.
It can assassinate even American citizens abroad without a scent of due process. Continue reading →
(PeoplesVoice) – When will the people of this nation understand that those they trust to guide them and protect them have nothing but contempt for them? Everyday there are people who have no work and have used up their 99 weeks of unemployment insurance, they are called the 99%’rs. Every day the people of this nation look into their television sets and hear the propaganda of a nation that is hell-bent on empire because they fear their own imminent collapse. This won’t affect the trans-national corporate hierarchy; they will just move to another country, it’s all the same to them. There is no patriotism and no loyalty to the United States among those that sit on the mantle of power.
The majority of Americans are decent, hard-working people, but they are none the less… stooges. They have been indoctrinated from birth to believe in a set of core values that are designed to keep them subservient and docile. They are the victims of propaganda that emanates from the government and the corporate media, designed to lead them to believe that we are “defending democracy” even though we have no real democracy of our own. (CNSNews) – A Republican congressman says all bills introduced in Congress should include a statement setting forth the specific constitutional authority under which a law is being enacted.
Rep. John Shadegg (R-Ariz.) says his Enumerated Powers Act will force Congress to re-examine the role of the national government and curb its “ever-expanding reach.”
“For too long, the federal government has operated without Constitutional restraint, creating ineffective and costly programs and massive deficits year after year,” Shadegg writes on AmericaSpeakingOut, a Republican Web site that seeks ideas from the American people.
Shadegg says the trend of Congress overstepping its role has gotten “alarmingly worse” in the past 18 months. Full story here.
(Fox) – Judge Andrew Napolitano clearly explains the Constitutional problems with the Arizona immigration law. As emotions run high at the lack of Federal action on the border, Napolitano strips out any emotional rhetoric and sticks to the Constitution. Continue reading →
(Infowars) – In this 3-part video interview with Tony DeMeo, Sheriff of Nye County, Nevada, he explains that he is a Constitutional Sheriff and that authority for public office holders is derived from the people. He tells the story about how he used the Constitution as his foundation in the saga of Nye County rancher Wayne Hage’s disputes over encroachments by the federal government. While Wayne Hage’s case centered around property rights in federally managed lands, Sheriff Tony DeMeo’s example is relevant for everyone to understand the power of local government, the importance of following the Constitution and upholding the Tenth Amendment (states’ rights and sovereignty). (HumanEvents) – Sound too conspiratorial to be true? Like the cover-up ops of spy novels? Well, it’s reality. And it is possibly the most bizarre, inhumane and abusive way that the White House is expanding its power over the American people.
It’s not an extremist belief or theory of the far right. It’s a fact that has been confirmed by The New York Times, The Washington Post and MSNBC and even documented by the far-left online magazine Salon.com.
And it’s the gravest nightmare of U.S. citizens and abandonment of our Constitution to date: a presidential assassination program in which U.S. citizens are in the literal scopes of the executive branch based upon nothing more than allegations of terrorism involvement as the branch defines it. (NewsWithViews) – A determined campaign is being waged in the United States that is perpetuated by the Godless humanists who endeavor, at the leading of Satan the greatest criminal mind in the Universe, to pave the way to a sheer control of the people and to establish the United States as a constituent of a one-world order.
This campaign is directed at a disarming of the people that they might be deprived of the tools to resist or challenge tyrannical totalitarian governance. But, hold on you might exclaim – this is not a totalitarian state, it is a Constitutional Republic. The heck you say, then how is it that our utilitarian communist president, Barack Obama, has been able to, in eighteen short months, accomplish the expropriation of private capital and industry and to establish a now nearly autonomous dictatorship under his despotic control? How is it that he has been able to assemble what amounts to a communist politburo via the unsanctioned appointments of an assemblage of communist progressives with an ascendancy over the will of the people? This could only take place under a totalitarian system of government. Read entire article
(TGBReport) – Government from Federal all the way down to the local level has been transformed from the elected officials working for us to us working for them. We need to send a message this election season that it is not about Republican or Democrat, Conservative or Liberal, it is about Insiders vs “We the People”. We must first ans foremost start by understanding our Constitutional duty to be informed on what are the President, Senators, Congressman, Governors, State Assembly, County and Township elected officials. (ActivistPost) – It has been reported that 46 states are on the verge of bankruptcy. Since states are Constitutionally mandated to balance their budgets, and do not possess the ability to print money, they’re finding themselves in a critically weakened position to challenge the Federal Government.
In our republic, states have sovereignty to create and enforce their own laws as long as they don’t violate the U.S. Constitution. The Tenth Amendment gives states the freedom from Federal laws and regulations if they deem them to be unconstitutional.
The Tenth Amendment: which makes explicit the idea that the Federal government is limited only to the powers granted in the Constitution, is generally recognized to be a truism. States and local governments have occasionally attempted to assert exemption from various federal regulations, especially in the areas of labor and environmental controls, using the Tenth Amendment as a basis for their claim. (C4L) – Bruce Fein’s American Empire: Before the Fall is not for the faint of heart. “You, your family, your friends, your professional colleagues, and your elected and appointed officials in the nation’s highest circles will fiercely resist the truths this book expounds,” the author warns. He’s not kidding. Only the most well informed constitutionalist will fail to be surprised by this book — and even that reader will come away from American Empire with a clearer understanding of the dangers facing our republic. In a little over 200 pages, Fein documents America’s slide from the rule of law into arbitrary power and the reduction of her citizens to comfortable serfs. The force that has brought about these changes is ceaseless war, which demands the sacrifice of real liberty for a spurious security.
When Campaign for Liberty first asked me to help edit the book some months ago, I feared it would be a dry foreign-policy tome. I could hardly have been more wrong: Fein writes with passion and verve; he is a man who has been robbed of his country, and readers who pick up American Empire will soon share the outrage he feels. (BaldwinLive) – Among the limited duties of the US Government enumerated in the federal Constitution is Article. IV. Section. 4. “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion.” However, for several decades now, the federal government in Washington, D.C., has shown great ambition and propensity to engage in activities to which it was never authorized, and to ignore those responsibilities with which it is specifically charged. The responsibility of the federal government to protect each State against invasion is a classic example of the latter. Continue reading →
(WashingtonTimes) – Arizona has enacted a law that enables state and local police to support fed- eral immigration en- forcement, in a care- fully circumscribed manner. This moderate statute is under vicious attack by the Obama administration and assorted amnesty advocates. Yet Arizona and her sister states in the Southwest could take dramatically stronger actions to bring order to the border. And they would have both history and the Constitution on their side. (Infowars) – Why is the President ignoring the Constitution and the outcry of the people to control the southern border? Why has he allied himself with Mexican President Felipe Calderon against Arizona’s legislative action to hopefully stop the invasion? It makes little sense until you understand his intent is to ram historically unpopular amnesty legislation through Congress. Obama told Arizona Senator John Kyl privately: “If we secure the border, then you all won’t have any reason to support comprehensive immigration reform,” blanket amnesty.
Outraged, Kyl characterized the President’s position on the border situation as “holding hostage” to push his amnesty package. All in spite of popular anti-amnesty sentiment, increased border violence, threats against border county Sheriffs and other law enforcement, resulting in the closing of state parks and border areas considered too dangerous for Americans to enter. So what’s going on, why this unconstitutonal federal stance and violation of Arizona’s 9th, 10th, and 11th Amendment sovereignty? Continue reading →
(ChuckBaldwin) – “We have no government armed with power capable of contending with human passions unbridled by morality and religion. Avarice, ambition, revenge, or gallantry, would break the strongest cords of our Constitution as a whale goes through a net. Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.” So said Founding Father and America’s second President John Adams. And he was absolutely right. And that is what is absolutely wrong with our country today: America is in a complete moral, societal, and cultural meltdown.
Founding Father and America’s first US Supreme Court Chief Justice John Jay correctly summarized the reason our new nation (and the fight for its liberty and independence) was successful. He wrote in Federalist 2, “With equal pleasure I have as often taken notice that Providence has been pleased to give this one connected country to one united people–a people descended from the same ancestors, speaking the same language, professing the same religion, attached to the same principles of government, very similar in their manners and customs, and who, by their joint counsels, arms, and efforts, fighting side by side throughout a long and bloody war, have nobly established general liberty and independence.” Continue reading →

(KurtNimmo) – NumbersUSA and Fox News report today that Obama may issue an executive order that will grant amnesty to between 10 and 30 million illegal aliens.
“Eight Republican senators and an independent group that supports tighter limits on immigration are warning that the Obama administration is drafting a plan to ‘unilaterally’ issue blanket amnesty for millions of illegal immigrants as it struggles to win support in Congress for an overhaul of immigration laws,” reports Fox News.
Chuck Grassley (R-Iowa), Orrin Hatch (R-Utah), David Vitter (R-La.), Jim Bunning (R-Ky.), Saxby Chambliss (R-Ga.), Johnny Isakson (R-Ga.), James Inhofe (R-Okla.), and Thad Cochran (R-Miss), have sent a letter to the White House asking for clarification on the issue: Continue reading →

(CNN) – A divided Supreme Court has ruled the government’s power to criminalize “material support” of a terrorist organization is constitutionally permissible.
The 6-3 ruling preserves a key provision of the 2001 Patriot Act, amid claims it threatens the free-speech rights of Americans who would assist non-violent activities of certain militant and terror groups.
At issue was whether the federal law allows prosecution of those with knowledge of “any service, training, expert advice or assistance” to a foreign terrorist organization, as designated by the U.S. government. – Source: CNN
(BigGovernment) – The Constitution of the United States of America is a remarkable document. It is eloquent in its simplicity, clarity and in its power. It revolutionized (first in America, and then throughout most of the western world) the relationship between those who are governed and those who govern. It has served as a governing template for much of the democratic western world.
Every federal office holder swears allegiance to the Constitution, not to any leader, not to any party, not to any political philosophy—only to this document, which is the foundation upon which our form of government is based and against which all legislation and judicial actions are measured. The President vows to do his job faithfully and, to the best of his ability, to preserve, protect, and defend the Constitution of the United States.
And while there is no way of divining what today’s crop of leaders would have thought of the Constitution had they been present at the founding when it was first circulated prior to ratification, we have our doubts whether many of today’s ruling class, including President Obama, would have found common cause with Washington, Adams (John), Jefferson, Franklin, Madison, Hamilton or Jay, all of whom loomed so large on the emerging American landscape. (TravisMonitor) – The nomination of Elena Kagan to the Supreme Court is the latest salvo in President Obama’s war on the Constitution. In this case the target is our First Amendment rights to free speech.
There has been a lot of commentary about her booting the military recruiters off the campus at Harvard and less about a far more important problem with Kagan – her anti-constitutional view of freedom of speech. Put simply, she just doesn’t believe in it. Continue reading →
In July 1987, during the Iran-Contra Hearings grilling of Oliver North, the American public got a glimpse of “highly sensitive” emergency planning North had been involved in. Ostensibly these were emergency plans to suspend the American constitution in the event of a nuclear attack (a legitimate concern). But press accounts alleged that the planning was for a more generalized suspension of the constitution.

(LewRockwell) – Yes, you read that right. The Constitution applies to terrorists. It also applies to stay-at-home moms, illegal immigrants, truck drivers, anti-government radicals, and Mahmoud Ahmadinejad.
Put differently, the Constitution does not apply only to citizens of the United States. It seems that protectionist collectivists treat this document like a two-year-old treats his favorite toy – unwilling to share, and incorrectly believing that it is his and his alone. This fallacy has become so propagated throughout the country’s general political mindset that a barbaric jingoism has resulted, leading people to automatically support the denial of constitutional protections of freedom for anybody who is a “terrorist.”

(AntiFascistCalling) – When Faisal Shahzad, a naturalized American citizen and 30-year-old son of a retired senior Pakistani Air Force officer was arrested in the failed plot to detonate a car-bomb in Times Square May 1, U.S. counterterrorism officials and their stenographers in the corporate media proclaimed a “connection” between Shahzad and the far-right jihadi outfit, the Tehrik-i-Taliban Pakistan (TTP).
Never mind that such “evidence” relies on the thinnest of reeds: that Shahzad had recently traveled to Pakistan, was allegedly in “contact” with the TTP and had even received “training” from a sectarian, clan- and tribal-based organization wary of outsiders who nevertheless, allegedly “approved” of an ill-conceived plan to kill hundreds of New Yorkers. (Reuters) – A national business lobbying group on Friday joined 20 U.S. states in a lawsuit challenging President Barack Obama’s overhaul of the U.S. healthcare system.
The joint lawsuit led by Florida and now grouping 20 states was filed on March 23 by mostly Republican attorneys general.
It claims the sweeping reform of the $2.5 trillion U.S. healthcare system, pushed through by Democrats in the U.S. Congress after months of bitter partisan wrangling, violates state government rights in the U.S. Constitution and will force massive new spending on hard-pressed state governments.
