Firearms and the Constitution Versus Treaties

“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under that Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.” – Article VI, Clause 2 of the U.S. Constitution

(TenthAmendmentCenter) – Recently I attended a gun show, where I handed out information material and answered questions on the Tenth Amendment Center.  Several people were concerned about the U.S. making a treaty that would gut the U.S. Constitution and potentially take away firearms from law abiding citizens here in the U.S.  They argued that the paragraph above from the Constitution places treaty law above the Constitution as the supreme law of the land.

Our Founders very clearly stated the conditions under which the U.S. Constitution could be amended, or changed, in Article 5.  It is quite illogical to conceive that our Founders would write such a brilliant document to be the foundation of our union, only to create a giant backdoor for foreign governments to come in and destroy the liberty we had worked so hard to achieve.   In fact, our Founders themselves said otherwise. None Dare Call It Tyranny – Sheldon Richman

(FFF) – If you want to know what tyranny is like, look around.

The national government — specifically the executive branch — can do pretty much what it wants. It could bomb Iran tomorrow without a declaration of war from Congress. It can — and does — conduct secret wars and covert operations against countries that have done nothing to us. Of course, they are secret only to the ignorant taxpayers who must finance them and perhaps suffer when the provoked retaliation occurs. It can have men behind PlayStation consoles in Nevada fire Hellfire missiles from aerial drones on people in Pakistan, Yemen, and elsewhere.

This tyrannical government can send any foreigner picked up anywhere in the world to third countries known for torturing prisoners. It can hold people accused of nothing indefinitely in prisons in Cuba and Afghanistan and torture them into making false confessions. It can conduct a war crimes trial in a military kangaroo court for a man, Omar Khadr, held captive for eight years after he was picked up at the age of 15 during a U.S. assault on villagers near Kabul. His torture-induced “confessions” will be admissible. All this is in violation of commitments under the Optional Protocol on the Involvement of Children in Armed Conflict not to treat children in war as though they were adults.

Every Bill Should State Its Constitutional Authority, Republican Congressman Says

(CNSNews) – A Republican congressman says all bills introduced in Congress should include a statement setting forth the specific constitutional authority under which a law is being enacted.

Rep. John Shadegg (R-Ariz.) says his Enumerated Powers Act will force Congress to re-examine the role of the national government and curb its “ever-expanding reach.”

“For too long, the federal government has operated without Constitutional restraint, creating ineffective and costly programs and massive deficits year after year,” Shadegg writes on AmericaSpeakingOut, a Republican Web site that seeks ideas from the American people.

Shadegg says the trend of Congress overstepping its role has gotten “alarmingly worse” in the past 18 months. Full story here.

Federal Government Working to Remove Sovereignty of States

(ActivistPost) – It has been reported that 46 states are on the verge of bankruptcy.  Since states are Constitutionally mandated to balance their budgets, and do not possess the ability to print money, they’re finding themselves in a critically weakened position to challenge the Federal Government.

In our republic, states have sovereignty to create and enforce their own laws as long as they don’t violate the U.S. Constitution.  The Tenth Amendment gives states the freedom from Federal laws and regulations if they deem them to be unconstitutional.

The Tenth Amendment: which makes explicit the idea that the Federal government is limited only to the powers granted in the Constitution, is generally recognized to be a truism. States and local governments have occasionally attempted to assert exemption from various federal regulations, especially in the areas of labor and environmental controls, using the Tenth Amendment as a basis for their claim. Why is the President ignoring the Constitution? – JT Coyote

America Is In A Societal Meltdown – Chuck Baldwin

(CNN) – A divided Supreme Court has ruled the government’s power to criminalize “material support” of a terrorist organization is constitutionally permissible.

The 6-3 ruling preserves a key provision of the 2001 Patriot Act, amid claims it threatens the free-speech rights of Americans who would assist non-violent activities of certain militant and terror groups.

Would Obama Have Supported Ratification of the US Constitution?

(BigGovernment) – The Constitution of the United States of America is a remarkable document. It is eloquent in its simplicity, clarity and in its power. It revolutionized (first in America, and then throughout most of the western world) the relationship between those who are governed and those who govern. It has served as a governing template for much of the democratic western world.

Every federal office holder swears allegiance to the Constitution, not to any leader, not to any party, not to any political philosophy—only to this document, which is the foundation upon which our form of government is based and against which all legislation and judicial actions are measured. The President vows to do his job faithfully and, to the best of his ability, to preserve, protect, and defend the Constitution of the United States.

And while there is no way of divining what today’s crop of leaders would have thought of the Constitution had they been present at the founding when it was first circulated prior to ratification, we have our doubts whether many of today’s ruling class, including President Obama, would have found common cause with Washington, Adams (John), Jefferson, Franklin, Madison, Hamilton or Jay, all of whom loomed so large on the emerging American landscape. The Constitution Applies to Terrorists

(LewRockwell) – Yes, you read that right. The Constitution applies to terrorists. It also applies to stay-at-home moms, illegal immigrants, truck drivers, anti-government radicals, and Mahmoud Ahmadinejad.

Professors: Arizona law passes constitutional test

(Alipac) – A panel of three law professors discussing Arizona’s anti-illegal immigration law Thursday at UCSD concurred that the law could well pass constitutional muster, although violations could occur as police officers enforce it.

The measure was signed into law last month by Arizona Gov. Jan Brewer. Among other things, it empowers local police to check a person’s immigration status if there is reasonable suspicion the person is in the country illegally and forbids agencies from adopting so-called “sanctuary” policies that restrict officers’ enforcement of federal immigration laws. MSM: States joined in suit against healthcare reform

(Reuters) – A national business lobbying group on Friday joined 20 U.S. states in a lawsuit challenging President Barack Obama’s overhaul of the U.S. healthcare system.

The joint lawsuit led by Florida and now grouping 20 states was filed on March 23 by mostly Republican attorneys general.

It claims the sweeping reform of the $2.5 trillion U.S. healthcare system, pushed through by Democrats in the U.S. Congress after months of bitter partisan wrangling, violates state government rights in the U.S. Constitution and will force massive new spending on hard-pressed state governments.
