Firearms and the Constitution Versus Treaties

(TenthAmendmentCenter) – Recently I attended a gun show, where I handed out information material and answered questions on the Tenth Amendment Center.  Several people were concerned about the U.S. making a treaty that would gut the U.S. Constitution and potentially take away firearms from law abiding citizens here in the U.S.  They argued that the paragraph above from the Constitution places treaty law above the Constitution as the supreme law of the land.

Our Founders very clearly stated the conditions under which the U.S. Constitution could be amended, or changed, in Article 5.  It is quite illogical to conceive that our Founders would write such a brilliant document to be the foundation of our union, only to create a giant backdoor for foreign governments to come in and destroy the liberty we had worked so hard to achieve.   In fact, our Founders themselves said otherwise. Who poses the real threat to the Internet?

We should be skeptical of any claims that net neutrality regulation is consistent with the First Amendment, let alone required by it. As First Amendment attorney Robert Corn-Revere has noted (“The First Amendment, the Internet & Net Neutrality: Be Careful What You Wish For”), “It should not be forgotten that the federal government’s initial impulse [in the mid-1990s] was to censor the internet and to subject it to a far lower level of First Amendment protection.”

Federal Government Working to Remove Sovereignty of States

(ActivistPost) – It has been reported that 46 states are on the verge of bankruptcy.  Since states are Constitutionally mandated to balance their budgets, and do not possess the ability to print money, they’re finding themselves in a critically weakened position to challenge the Federal Government.

In our republic, states have sovereignty to create and enforce their own laws as long as they don’t violate the U.S. Constitution.  The Tenth Amendment gives states the freedom from Federal laws and regulations if they deem them to be unconstitutional.

The Tenth Amendment: which makes explicit the idea that the Federal government is limited only to the powers granted in the Constitution, is generally recognized to be a truism. States and local governments have occasionally attempted to assert exemption from various federal regulations, especially in the areas of labor and environmental controls, using the Tenth Amendment as a basis for their claim. Why is the President ignoring the Constitution? – JT Coyote

(Infowars) – Why is the President ignoring the Constitution and the outcry of the people to control the southern border? Why has he allied himself with Mexican President Felipe Calderon against Arizona’s legislative action to hopefully stop the invasion? In a case pitting free speech against national security, … on Monday upheld a federal law that makes it a crime to provide “material support” to foreign terrorist organizations, even if the help takes the form of training for peacefully resolving conflicts.

Chief Justice John G. Roberts Jr., writing for the majority in the 6-to-3 decision, said the law’s prohibition of providing some types of intangible assistance to groups the State Department says engage in terrorism did not violate the First Amendment.

Kagan Compared NRA to KKK

(NRO) – It has become clear that Elena Kagan, Obama’s most recent Supreme Court nominee, is no friend of gun rights, to say the least. While clerking for Supreme Court justice Thurgood Marshall in 1987, she wrote the judge that she was “not sympathetic” to a Second Amendment–based challenge to the D.C. gun ban. While serving in the Clinton administration, she wrote a memo that “paved the way for an executive order banning dozens of semiautomatic weapons,” according to the L.A. Times.

And National Review has learned that in 1996, Kagan apparently tied the NRA to the KKK — yes, the KKK — while debating the Clinton administration’s position on a bill.

The bill in question was the Volunteer Protection Act, which, when it was passed and signed the following year, protected some non-profits’ volunteer workers from tort liability in certain cases. The administration worried that it would apply to volunteers from unlikable non-profits. Read entire article

(TenthAmendmentCenter) – By all accounts, the past several weeks have been an extraordinarily difficult span of time for the residents of the coastal areas of Louisiana, Mississippi, Alabama and western Florida. A toxic combination of crude oil along with multiple gasses and chemicals continues to spew unabated into the Gulf of Mexico, the full impact of which is still a giant unknown. Tar balls are washing ashore along the seaboard and crude is oozing into marshes, while fishing has come to grinding halt. Amidst this disaster, a number of troubling stories have begun circulating (some confirmed and some remaining anecdotal) of a media blackout underway along stretches of beach, of troop deployments, of possibly using a tactical nuke to seal the fissure, and of the federal government preventing the impacted States and local communities in some instances from taking the necessary actions to prevent the sludge from making landfall or entering estuaries. FBI Data Again Shows More Guns = Less Crime

(NRA-ILA) – Anyone needing proof that fanaticism for gun control hasn’t waned on Capitol Hill, that anti-gunners are—as Sen. Dianne Feinstein (D-Calif.) put it last year—only waiting to “pick the time,” should watch the video of Mexican president Felipe Calderon’s speech to Congress last week, versions of which have been posted on youtube.com. When Calderon asked that the federal “assault weapon” ban be re-imposed, a very large number of U.S. Representatives and Senators present gave him a standing ovation.

However, on Monday the FBI released crime statistics that should cause the applauding anti-gunners to sit on their hands. The statistics indicate that between 2008 and 2009, as gun sales soared, the number of murders in our country decreased 7.2 percent.  That amounts to about an 8.2 percent decrease in the per capita murder rate, after the increase in our nation’s legal and illegal population is taken into account. And it translates into about a 10.5 percent decrease in the murder rate between 2004, when the ban expired, and the end of 2009. And finally, it means that in 2009 our nation’s murder rate fell to a 45-year low.

The FBI’s report was also bad news for anti-gunners elected to other offices. With the Supreme Court’s decision in McDonald v. City of Chicago no more than a few weeks away, Mayors Bloomberg, of New York City, and Daley, of Chicago—who fear that it will require them to respect the Second Amendment for the first time—have continued to beat their drums for gun control. As we have noted, Bloomberg recently encouraged a Senate committee to support the Lautenberg-King terrorist watchlist bills. And last week Daley told a Chicago Reader reporter, who expressed skepticism about the effectiveness of Chicago’s handgun ban, “It’s been very effective.” Holding a bayonet-equipped rifle, Daley added, “If I put this up your butt, you find out how effective it is.”

But, murders in big cities declined over 11 percent between 2008 and 2009, translating to over a 12 percent decrease in the big city murder per capita rate. We hope, but don’t expect, that the indisputable fact that an increase in gun ownership does not necessarily correspond to an increase in crime, will reduce the frequency of Bloomberg’s stunts aimed at gun shows, and Daley’s periodic rants against the firearm industry. – Source: NRA-ILA

Senator: Kagan Argued Government Could Ban Books

(PaulWatson) – In an interview on NBC’s “Meet the Press,” Senator Mitch McConnell pointed out that Obama’s Supreme Court nominee Elena Kagan once argued that the government should have the power to ban books and censor political pamphlets, as yet more alarming information on Kagan’s hostility towards the First Amendment comes to light.

During the Citizens United vs. FEC case, Kagan’s office was asked by Chief Justice John Roberts if the government could ban publications it they were paid for by a corporation or labor union.

“If it’s a 500-page book, and at the end it says, ‘and so vote for x,’ the government could ban that?” Roberts asked, to which Kagan’s deputy, Malcolm L. Stewart, said the government could censor such information.

Judge orders release of 9 Hutaree militia

(Freep) – A federal judge in Detroit today ordered the release of nine members of a Lenawee County Christian militia group freed on bond over the objections of federal prosecutors.

“The United States is correct that it need not wait until people are killed before it arrests conspirators,” U.S. District Judge Victoria Roberts said in a 36-page decision. “But, the Defendants are also correct: their right to engage in hate-filled, venomous speech, is a right that deserves First Amendment protection.”

Some say that you can “vote with your feet” — a phrase popularized by Ronald Reagan (most often taken out of context) in 1976 and a philosophy some attribute to Ayn Rand which was alluded to in Atlas Shrugged. Nevertheless, taken for only the meaning of the phrase in itself, it is questionable whether that philosophy exists today or if it is even plausible.
