FCC Using Cybersecurity To Regulate Internet

(FierceGovernmentit) – Yet another federal agency envisions a possible broader role for itself in securing private sector Internet infrastructure. The Federal Communications Commission issued on August 9 a notice (.pdf) soliciting public comment on an anticipated FCC plan to address vulnerabilities to core Internet protocols, as well as cybersecurity threats to all end users.

“Cybersecurity is a vital topic for the Commission because end user lack of trust in online experiences will quell demand for broadband services,” the notice states. The National Broadband Plan calls for the FCC to issue a Cybersecurity Roadmap. A plan, the FCC says in the notice, should be completed by November 2010. Continue reading

Lawsuit over Geronimo’s Remains dismissed because Government is Legally God

(America20xy) – A federal judge has dismissed a lawsuit filed against the Federal Government and Yale University by 20 descendents of the Apache warrior Geronimo, who say that their famous ancestor’s remains were stolen from Fort Sill, Oklahama and are illegally in the possession of “Skull and Bones”– a secret society at Yale.

Among those whom Geronimo’s ancestors accuse of stealing their ancestor’s remains years ago is former Skull and Bones member Prescott Bush– the now deceased father and grandfather of Presidents Bush Sr. and Jr.  Both former presidents were also members of the secret society, as well as Senator John Kerry.

Arizona Sheriff: ‘Our Own Government Has Become Our Enemy’

(CNSNews) – Pinal County (Ariz.) Sheriff Paul Babeu is hopping mad at the federal government.

Babeu told CNSNews.com that rather than help law enforcement in Arizona stop the hundreds of thousands of people who come into the United States illegally, the federal government is targeting the state and its law enforcement personnel.

“What’s very troubling is the fact that at a time when we in law enforcement and our state need help from the federal government, instead of sending help they put up billboard-size signs warning our citizens to stay out of the desert in my county because of dangerous drug and human smuggling and weapons and bandits and all these other things and then, behind that, they drag us into court with the ACLU,” Babeu said. MSM: Judge Blocks Key Parts of Immigration Law in Arizona

(NYTimes) – A federal judge, ruling on a clash between the federal government and a state over immigration policy, has blocked the most controversial parts of Arizona’s immigration enforcement law from going into effect.

In a ruling on a law that has rocked politics coast to coast and thrown a spotlight on the border state’s fierce debate over immigration, United States District Court Judge Susan Bolton in Phoenix said some aspects of the law can go into effect as scheduled on Thursday.

The parts of the law that the judge blocked included the sections that called for officers to check a person’s immigration status while enforcing other laws and that required immigrants to carry their papers at all times. Judge Bolton put those sections on hold until the issues are resolved by the courts.

The judge’s decision, which came as demonstrators opposed and supporting the law gathered here and after three hearings in the past two weeks in which she peppered lawyers on both sides with skeptical questions, seemed unlikely to quell the debate. Full article here

Federal Government Working to Remove Sovereignty of States

(ActivistPost) – It has been reported that 46 states are on the verge of bankruptcy.  Since states are Constitutionally mandated to balance their budgets, and do not possess the ability to print money, they’re finding themselves in a critically weakened position to challenge the Federal Government.

In our republic, states have sovereignty to create and enforce their own laws as long as they don’t violate the U.S. Constitution.  The Tenth Amendment gives states the freedom from Federal laws and regulations if they deem them to be unconstitutional.

The Tenth Amendment: which makes explicit the idea that the Federal government is limited only to the powers granted in the Constitution, is generally recognized to be a truism. States and local governments have occasionally attempted to assert exemption from various federal regulations, especially in the areas of labor and environmental controls, using the Tenth Amendment as a basis for their claim. The CLEAR Act of Another Federal Land Grab – Cassandra Anderson

(Infowars) – U.S. Representative Louie Gohmert (R-TX) addressed Congress on July 15th to report the Natural Resources Committee’s passage of HR 3534, the Consolidated Land, Energy and Aquatic Resources Act (CLEAR Act) of 2009. Congressman Gohmert said that the bill was to “deal with the disaster in the Gulf of Mexico” but it contains plans for the federal government to acquire land and was introduced in 2009.

DoD, Guard establish eight Homeland Response Force units

(AmericanFreePress) – Eight more homeland response force units will be established in fiscal year 2012, Defense Department and National Guard Bureau officials said here today.

The units are regional forces that will cross state lines when needed. They are part of a restructuring of the nation’s chemical, biological, radiological, nuclear and high-yield explosive consequence management enterprise.

Massachusetts (supported by Connecticut and Vermont), New York (supported by New Jersey), Pennsylvania, Georgia, Texas, Missouri, Utah and California each will host a homeland response force unit.

One unit will be based in each of the 10 Federal Emergency Management Agency regions. The units are scheduled to have 570 Guardsmen, and each will have a medical team, a search and extraction team, a decontamination team and very robust command and control capabilities, officials said. The Serious Tracking of Americans Begins

(TheLibertyVoice) – They have passed the health bill, they have passed the financial regulations bill and they have snuck stuff into the stimulus package bills. They are going to track your money and your body. Here’s the first few things they are doing. This is step one. It will only get worse from here.

…the Health Care Bill mandates, according to Numismaster.com, Starting on January 1st in 2012, S federal law will require coin and bullion dealers to report to the Internal Revenue Service all gold and silver coin purchases and sales greater than $600.
No that is not an error, they tacked the gold coin tracking regulations into the health bill. They are just tacking stuff on wherever they can.

As for your body, you will be required to have an “electronic health record”, by 2014. They snuck this into one of the “stimulus” bills. The electronic record will include an obesity rating. The information will be required to be on a “national exchange” with only secure access (Hah!). Why the F does your obesity rating have to be on a national exchange? This is a tip off to how micro-managed they are going to attempt to run your life.

Keep in mind that the health bill and financial “reform” bill are thousands of pages, with much of the details left up to the new agencies to fill in. Obama is appointing major league interventionists to head these agencies. They are completely clueless as to how an economy works. Their regs will be over the top. It will stifle America in so many ways, it is difficult to imagine. I was in East Berlin the year before the Wall came down. I saw what constant monitoring and micro-management did to people. It is not pretty. The gray, the drab, the despair was everywhere. When you can only take orders and wait for approvals and are constantly watched, it saps the life out of you. America is going to be changing and the government is going to try and watch you and monitor your vitals, as if you were a lab rat, as it does the changing.

Gun Rights Must Be Honored by States, Cities, High Court Rules in 5-4 Vote

(Bloomberg) – The U.S. Supreme Court extended the reach of the constitutional right to bear arms by saying it binds state and local governments as well as the federal government.

The justices, voting 5-4 in a case involving Chicago’s handgun ban, said that individual gun rights were among the fundamental guarantees protected against state interference through a constitutional amendment after the Civil War.

The ruling broadens the sweep of the court’s 2008 ruling interpreting the Constitution’s Second Amendment as protecting the rights of individuals, rather than just those of state-run militias. It’s a victory for the National Rifle Association, which joined a group of Chicago residents in challenging the city’s laws.

It will open a new front in the fight over gun rights, setting the stage for courtroom battles over the constitutionality of weapons restrictions around the country.

FSB Wants to Shut Down Sites at Will

(MoscowTimes) – Prosecutors may get to shut down web sites over extremism charges for an unlimited time if the State Duma passes new legislation drafted by the Federal Security Service, Vedomosti reported Friday.

Internet service providers will be obliged to shut down web sites within three days upon receiving a “motivated letter” from prosecutors, according to the draft.

Sites will be able to return online only after a court rules that they did not violate anti-extremism laws. Even if a web site wins its case, it may be kept offline for up to a month from the day it was suspended.

MSM: High Court upholds terror law after free speech challenge

(CNN) – A divided Supreme Court has ruled the government’s power to criminalize “material support” of a terrorist organization is constitutionally permissible.

The 6-3 ruling preserves a key provision of the 2001 Patriot Act, amid claims it threatens the free-speech rights of Americans who would assist non-violent activities of certain militant and terror groups.

At issue was whether the federal law allows prosecution of those with knowledge of “any service, training, expert advice or assistance” to a foreign terrorist organization, as designated by the U.S. government. – Source: CNN

FCC Moves to Regulate Internet

(CNSNews) – The Federal Communications Commission (FCC) voted on Thursday to begin the formal process of bringing the Internet under greater federal control – a move sought by both President Barack Obama and FCC Chairnman Julius Genachowski.

This step comes after the federal D.C. Circuit Court of Appeals in April rebuked the FCC in its attempt to enforce a controversial regulatory doctrine called Net Neutrality, which would allow the government to prevent private Internet providers from deciding which applications to allow on their networks.

The court said that the FCC did not have the authority to prevent Comcast, specifically, from blocking certain peer-to-peer Web sites. Continue reading
